THE LAW DEPARTMENT
Role
The Law Department of the Church was created in 1937/1938.
The department acts in legal matters for the Church at
large and all of its courts, councils, committees, the
Church of Scotland General
Trustees, the Church
of Scotland Trust and the Church
of Scotland Investors Trust.
Following the review of the Church's internal structure
in 2005, the department now comes under the Central
Services Committee of the Support and Services Council.

The department also acts for individual congregations
and is available to give advice on any legal matter
arising. The post of solicitor of the Church is now
customarily held along with the traditional posts of
law agent of the General Assembly and the custodier
of former United Free Church titles.
When, for any reason, a property becomes surplus to
requirements, the Law Department generally acts for
the Church body concerned in connection with its sale.

Legal circulars
To assist Church of Scotland congregations, the Law Department
from time to time prepares circulars on various legal
topics affecting congregations such as health and safety,
employment law and the Disability Discrimination Act.
These are made available to office
bearers only and therefore are available on our
extranet only - our dedicated online resource for office
bearers, staff and the ministries.
The Law Department team
A number of support staff assist the Solicitor of the
Church, Janette Wilson, her depute solicitor Mary Macleod,
and the Church's team of assistant solicitors and titles
clerk.
